What are the rules on creating custom art that contains pro sports info or char (such as Disney) ?
I create and sell hidden design art and customers want certain themes such as pro teams or Disney characters. I don't know if I'm allowed to include such items or themes.
The "hidden design" aspect is what makes this question more difficult to answer.
Certainly, if your designs contain reconizable Disney or other copyrighted images, you could be subject to copyright infringement actions. Same with copyrighted logos for pro, college and many other sport organizations.
In general, if you change an image to a great enough degree, then you COULD be safe from lawsuits. But, if you change it to a great enough degree, then the image might not be recognizable, and defeats the purpose of you client's request to use the images.
Here's how I see it. (and, please understand that I do not offer any legitimate legal advice, just personal opinion) If your design is such that the target image is not immediately obvious, but only appears after some level of concentration or observation, and, at some point, the observer finally "sees" a clearly recognizable image of, say, Mickey Mouse, you might be guilty of copyright infringement.
As a professional graphic designer, this is one aspect I would steer clear of. Without licence to use these images, I would be exposed to expensive legal action.
